In consideration of being allowed to participate in any way in any Just Play Apps, Inc. (“Just Play” or “GoodRec”) programs, events, or activities, I understand, acknowledge, and agree to the following:
Role of GoodRec. GoodRec provides a technology platform that facilitates the discovery, registration, and coordination of recreational sports activities. GoodRec does not own, operate, manage, supervise, control, or maintain any facilities or venues, does not provide coaching, training, officiating, medical, or safety services, and does not guarantee the conduct, skill level, fitness, or behavior of any participant, organizer, referee, or venue, and makes no representations regarding the safety or suitability of any activity.
I understand the physical requirements of the program, event, or activity in which I will be participating, and certify that I am physically fit and able to participate and have not been advised otherwise by a qualified medical professional.
I agree to comply with any and all rules, regulations, terms, and conditions for participation in the program, event, or activity, including the rules of any sport and the Participant’s Code of Conduct. I agree to inspect the equipment, facilities, and premises prior to participation. If I believe anything is unsafe, I will inform the event organizer, team captain, referee, or the facility owner or operator, and will refuse to participate if the issue is not corrected.
Event Organizers. Certain activities may be organized, hosted, or facilitated by third-party individuals or entities (“Organizers”). Organizers are independent parties and are not employees, agents, joint venturers, or representatives of GoodRec. GoodRec does not control and is not responsible for the actions, omissions, supervision, or decisions of any Organizer.
No Control Despite Compensation. Any compensation or fees paid by GoodRec to Organizers or venues are for administrative, access, or facilitation purposes only and do not reflect or create control, supervision, or responsibility by GoodRec for any activity, premises, equipment, or participant.
Assumption of Risk. I acknowledge that participation in recreational sports involves inherent and unavoidable risks that cannot be eliminated without fundamentally altering the nature of the activity, and I voluntarily choose to participate despite those risks. I further acknowledge and fully understand that participation involves risks of serious injury, permanent disability, death, property loss, and other damages.
These risks include, without limitation, those caused by: (a) the actions, inactions, or ordinary negligence of GoodRec, other participants, volunteers, spectators, coaches, event officials, referees, organizers, or venues; (b) conditions of premises, facilities, or equipment; (c) rules of play; (d) weather conditions; (e) the skill, ability, or condition of other participants; and (f) vehicular traffic. I further acknowledge and fully understand that there may also be other risks that are not known or foreseeable at this time. GoodRec cannot control these risks, nor has GoodRec judged my skill level or ability prior to allowing me to participate and consequently is not in a position to guarantee my personal health or safety during my participation in the programs, events, or activities. I understand that GoodRec does not inspect or evaluate facilities, equipment, playing conditions, weather, or participant readiness and assumes no duty to ensure the safety of any activity or environment.
I KNOWINGLY, INTELLIGENTLY, AND VOLUNTARILY ASSUME ALL SUCH RISKS, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF GOODREC OR OTHERS, whether known or unknown, foreseeable or unforeseeable, and assume full responsibility and liability for my participation.
Waiver and Release. I, on behalf of myself and my heirs, HEREBY WAIVE, RELEASE, DISCHARGE, AND AGREE NOT TO SUE GoodRec and its affiliates, directors, officers, employees, volunteers, agents, referees, organizers, venues, and other participants (collectively, the “Releasees”) from any and all claims, demands, damages, injuries, losses, liabilities, and expenses, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF ANY RELEASEE, whether known or unknown, suspected or unsuspected, arising out of or related to my participation in any GoodRec activity.
Indemnification. I agree to indemnify, defend, and hold the Releasees harmless from and against any claims, damages, liabilities, losses, and expenses arising out of or related to (a) my participation, (b) my violation of these Terms or the Code of Conduct, or (c) my interactions with Organizers, venues, or other participants, or my conduct during any activity.
Medical Consent. I consent to receive medical treatment deemed advisable in the event of injury, accident, or illness and release GoodRec and all related parties from responsibility for such actions.
Code of Conduct Disclaimer. The Participant’s Code of Conduct applies to all GoodRec participants and is intended to promote respectful and sportsmanlike behavior. The Code of Conduct does not create any duty on the part of GoodRec to supervise, monitor, control, or enforce participant conduct or to ensure the safety of any activity. Participants are solely responsible for their own conduct and compliance with applicable rules and laws. Violation of the Code of Conduct may result in removal from activities and may be considered evidence of assumption of risk and contributory or comparative fault.
Code of Conduct. The Participant’s Code of Conduct applies to all GoodRec participants. This code applies to players as individuals or as a team, and the penalties can apply to any individual or an entire team. This code becomes effective as soon as participants arrive at the facility of play and remains in effect until the participants leave the facility.
The purpose of the Participant’s Code of Conduct is to promote a safe and fun environment for all participants in the GoodRec community. All GoodRec participants should exhibit ethical, respectful, and sportsmanlike conduct. GoodRec celebrates diversity, equity, and inclusion, and prohibits discrimination based on race, sex, religion, national origin, age, sexual orientation, and gender identity.
By using this app, you agree to abide by our Terms of Service, which includes our strict policy against objectionable content and abusive behavior. We do not tolerate any content or conduct that is illegal, threatening, harassing, abusive, defamatory, discriminatory, offensive, or otherwise objectionable. You are responsible for all content you post and engage with on this app. If you encounter content that violates our policies, please report it immediately. We reserve the right to remove any content and to restrict or terminate access to users who violate these terms. By using this app, you agree that you understand and will adhere to these guidelines and that failure to comply may result in the suspension or termination of your account.
The Participant’s Code of Conduct is subject to change without notice.
No Participant Shall:
Publicity and Likeness Release. I hereby grant to GoodRec and those acting with its authority the irrevocable, perpetual, worldwide, royalty-free right to photograph, videotape, record, or otherwise capture my name, image, likeness, voice, and sounds, and any biographical information provided by me (collectively, the “Content”), in connection with my participation in any GoodRec program, event, or activity. To the extent permitted by law, I acknowledge and agree that the Content constitutes works made for hire. To the extent the Content does not qualify as a work made for hire, I hereby irrevocably assign to GoodRec all right, title, and interest in and to the Content. GoodRec may use, reproduce, modify, distribute, display, perform, and sublicense the Content, in whole or in part, in any media now known or hereafter developed, for any lawful purpose, including advertising, marketing, promotional, and commercial purposes, without further notice to or compensation for me.
Communications Consent. By creating an account or participating in any GoodRec activity, I consent to receive transactional and service-related communications from GoodRec, including SMS or text messages related to scheduled games, confirmations, cancellations, and other service updates. Such messages are non-promotional and necessary for the operation of the Services. Message and data rates may apply, and message frequency may vary. I may opt out of SMS messages at any time by replying STOP, update my preferences through the app settings, or reply HELP for assistance. Additional information regarding communications and data practices is available in GoodRec’s Privacy Policy.
Limitation of Liability. To the maximum extent permitted by law, GoodRec shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to participation in any activity, even if advised of the possibility of such damages. GoodRec makes no representation or guarantee that any insurance coverage will apply to any injury, loss, or claim arising from participation in any activity. Participants are solely responsible for maintaining their own health, medical, disability, or liability insurance and agree not to rely on any insurance carried by GoodRec, Organizers, or venues.
Governing Law; Venue. These Terms are governed by the laws of the state in which the applicable activity occurs, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in that state.
Acknowledgment and Construction. I intend that this Waiver and Release of Liability and these Terms and Conditions be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I HAVE READ THESE TERMS AND CONDITIONS CAREFULLY AND FULLY UNDERSTAND THEIR CONTENT AND EFFECT. I UNDERSTAND THAT BY AGREEING TO THESE TERMS I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND I AGREE TO THESE TERMS KNOWINGLY, INTELLIGENTLY, AND VOLUNTARILY, WITHOUT ANY INDUCEMENT OR DURESS.
